1. Should I give a recorded statement to the insurance company?
People who have been in car crashes ask me regularly, “Should I give a recorded statement to an insurance company?” My recommendation is that you don’t give a recorded statement to an insurance company unless you have an attorney involved. The reason for that is insurance adjusters are trained to get information and ask questions in a specific way that helps their case and hurts yours. I would not give a statement without an attorney being involved.
2. Will my car accident case go to trial?
People who’ve been in a car crash often ask, “Will my case have to go to trial?” Because they don’t want to be involved in that. Initially, it’s very difficult to tell somebody if their specific case will go to trial. We are able to resolve most of our cases without going to trial because we get a fair resolution of them. If we can’t get a fair resolution, some cases have to go to trial. If we do have to take a case to trial, we’re going to be prepared for trial, and we’re going to make sure that you’re prepared as well so that there won’t be anything to worry about.
3. How long will my car accident case take?
People ask me all the time, “How long does it take to resolve my car crash case and can we get this case resolved really quickly?” One of the things that’s difficult about resolving a case extremely quickly is that you need to make sure, before you resolve it, you know what the injuries are. You need to get the diagnosis from doctors, get treatment from the doctors, and know what’s working and what isn’t to determine what future treatment you’re going to need and how that’s going to impact you. Once you have a good understanding of what the injury is and what the treatment’s going to be for that, we can get that demand to the insurance company pretty quickly. Then from there, it depends on if they’re going to make a fair offer to settle it or if we have to prepare the case to go into litigation. It’s a very personalized question and hard to answer on a general format. The one thing that’s always true is we’re always pushing the insurance companies to get the case resolved fairly.
